    It has been labeled a tax grab and a bureaucratic nightmare by conservative antitax activists, an infringement on states? rights and a federal encroachment on the almost-sacred ground of Internet commerce.

    Yet legislation to help states force online retailers to collect sales taxes easily cleared its first procedural hurdle on Monday evening, and even its fiercest opponents are looking to the House for a last stand. The Senate voted 74-20 to take up the legislation for debate and amendment.


    The bill, known as the Marketplace Fairness Act, is that rare piece of legislation that has turned Democrat against Democrat, Republican against Republican and business against business, while uniting states as different as New Hampshire, Montana and Oregon ? which have no sales taxes ? against virtually every other state.

    An odd confluence of events has swung the political momentum to one side. Less than a week after the Senate could not muster 60 votes to expand gun background checks supported by a vast majority of voters, lawmakers from both parties are poised to steamroll opponents and greatly broaden the imposition of sales taxes on the Internet.

    Under the bill, online retailers would collect an estimated $22 billion to $24 billion that now goes uncollected. A final vote is expected in the Senate by the end of the week. When the House will take up the issue is uncertain.


    Old-fashioned retailers are going bust, leaving towns marred by vast, empty storefronts. Those that remain complain of ?showrooming,? when shoppers inspect their wares, then leave the store to buy the same products on the Internet, finding lower prices and avoiding sales taxes.

    Republicans including Senators Mike Enzi of Wyoming and Lamar Alexander of Tennessee are as adamantly in favor of the bill as Democrats.

    Finally, Senate Democratic leaders needed a bill to move to quickly after gun legislation all but died last week, and the Internet tax bill was ready.

    President Obama on Monday threw his support behind the bill, which the White House said ?will level the playing field for local small business retailers that are in competition every day with large out-of-state online companies.?

    The bill would allow states to require all Internet sellers to collect sales taxes for the state and local governments of the buyers. State governments would be required to provide software free to Internet retailers to calculate sales taxes. Online retailers with out-of-state sales of less than $1 million a year would be exempt.

    Many of the largest Web retailers have already begun collecting sales taxes. Amazon.com has joined a vast constellation of brick-and-mortar retailers in collecting taxes, leaving eBay to fight an increasingly lonely battle. In March, the Senate held a test vote of sorts, a nonbinding amendment to the Senate budget that mirrored the Marketplace Fairness Act. '

    Why? Because it will destroy the thousands of small internet sellers and those who use Ebay.

    Amazon is building vast warehouses in run down states and in return is getting deal that exempt it from certain tax.

    This isnt about protecting the shops.Its about Amazon killing off the one thing that can be more competitive than them and long term destroy their business.Small internet retailers with websites and on Ebay.

    You have knocked the nail on the head Durham.

    Many small retailers were lured in by Amazon and listed their products only to become dismayed at the amount of commission they were charging.

    Subsequently they lost faith and bailed out of Amazon only to find Amazon never ever deleted their product listings. So searches for their products Amazon now outrank them in google even though they mark the product out of stock and with no resupply date.

    The march of the globalists and their moves to eradicate the small people gathers pace.

    Google search results in the last year or so are now freezing out the smaller operators in favour of the bigger brands.
    Some schools of thought take the view this is what panda and penguin updates was about.

    An example, if I want a small cosy hotel close to Lake Windermere I want a list of independent hotels which I can compare. I don't want booking.com at the top of the list and other operators like tripadvisor and laterooms trying to get me to buy what they consider I want based on the amount of commission they can screw from the hotel. Half the time these places won't even return results in the area I want.

    It's "Baptists and Bootleggers" legislation i.e. ostensibly to make sure everyone "pays their fair share" (Baptist side of the argument), however, sponsored and lobbied for by a huge corporate to create a legal monopoly.

    Yep. What ive heard is the big boys will easily cope with this, processing the tax code for 50+ states. If your'e a small supplier, it will be near impossible, and hugely expensive.

    Its just using govt to create another barrier to entry and thwart any semblance of a free market and consumer choice. Hence why majorities of both parties are on board.

    Is the tax due? Or is the bill coming in to force tax to be charged in the buyer's state? If it is needed, then how can the likes of Amazon etc already be collecting these sales taxes?

    And isn't this just the same as the VAT scene in the EU? If you are selling your goods in another EU country then, subject to a smallish threshold (and much less that $1m) you need to start charging local rates of VAT to your consumers?

    And finally if the threshold is $1m, then doesn't this protect the smaller businesses that some of the earlier posts portray as the victims here? And more, protect those local small businesses in the states where sales tax is levied already?

    The facts above belong to everybody; the opinions to me.... the distinction is yours to draw.

    Does the sales tax apply depending on the state the seller is in, or the buyer is in? It would seem the latter. So what happens if you buy from a bricks-and-mortar shop? Do they check to see what state you live in? I doubt it. Are there customs at state boundaries? Nope.

    It does seem unfair that shop sellers have to charge tax, but online sellers don't. But it may be unfair because sales are taxed, period.

    So this legislation means that if you go into an Oregon shop, you will be able to buy tax-free, and take it home to, say, NY. But if you buy online from an Oregon shop, you will have to pay NY sales tax when it is delivered to you. In other words, it's still going to be a mess.

    I thought European VAT rule inconsistencies were bad enough.

    It's basic functionlaity already built into any accounting package or online selling software they're already using.

    And even if not it'll take about an hour in Excel to work out.

    It's not even a increase in taxes: the taxes are already due it's just with the sellers not charging it the buyer is meant to go down his local tax office and settle up.

    First once in whos to say this wont be reduced.Also this puts a massive ceiling on online sales and a business growing.This is simply Amazon mainly trying to kill small business.Ebay is fighting hard to stop it because it will hit hard a lot of their small business sellers.

    Amazon are losing the battle against smaller sellers.Many warehouses now offer very similar systems to Amazon for small sellers.I use one.Amazon cant compete and they want to kill these small companies.

    The internet is the one place a small person can take on the big companies.Amazon want to kill that.

    Really? Do you mind showing me some links to these accounting packages ?

    You tend to be able to create those codes - but that is a hugely laborious process for a small business (and nothing for AMZN of course).

    Also these rates changes from time to time (even UK VAT went from 15% to 17.5% then back to 17.5% and then 20%). The sales tax exemption list also changes from time to time.

    Now, the online shopping carts also need to take into account of these rates.

    Don't a lot of small businesses selling on Ebay also sell on Amazon and other sites?

    Was recently playing around with software called Linn Works, which is stock inventory and shipping inventory software for online traders and it integrates with Ebay, Amazon as well as Magento and other e-commerce sites.

    Linn Systems also produce software called "Mean Pricer" or something which allows to monitor and undercut competitors on Amazon. Your own race to the bottom, if the comp also has the same software! Posted Image

    The other thing that the traditional items such as s/h CD's and DVD's now seem almost unsellable unless you let them go often less than they cost to post and pack.

    Nope - there is case law in the US stating that sales tax is not due on items sold over the internet in different states. if you sell over the internet in the same state, then tax is due. Otherwise, no.

    Yes,iv now got all my stock in a shared warehouse where we all book in from home and its then sent out from the warehouse.The couriers are based in the same warehouse as well.It undercuts Amazons operation.I also get the containers into there so its a one stop option.

    Yes they do ,and so do i.
    However i never stock anything thats a common item as like you say on Amazon everyone cuts and cuts to be cheapest and there is no margin.
    Ebay is a far better platform for small companies IMO.Google drives a lot of sales.
    Postage is a massive problem now for online sellers and iv moved to higher value items that can carry postage easier.Mid range items are getting almost priced out now due to postage,and most of thats down to fuel costs.

      Gold may or may not be a currency or hedge against crisis but it has been traded for thousands of years. That being the case, gold can probably be expected to fluctuate in value but it's not going to disappear. At least not in a straight line.

      Jeff Kilburg, founder & CEO of KKM Financial, is a gold trader rather than a fundamental purist. For him the underlying demand gives him a trading backstop, but getting ahead of price fluctuations are how he brings home the bacon.

      Kilburg says the trader in him thinks gold is on the cusp of a breakout. "I want to see it get back above $1,500, but I think you can layer into gold positions here," says Kilburg in the attached video.

      Why wait? Because good commodity traders know to respect the technicals. $1,500 is a level from which gold broke down. Those who bought that level and rode gold to the lows and back the mid-$1,400s are weak holders likely to breath a sigh of relief and bail when they get back to their cost basis. Traders who bought lower will see resistance at $1,500 and take profits. Either way Kilburg says it pays to wait.

      UFC 159 Results: Jon Jones Beats Chael Sonnen Despite Injured Foot, Retains Light Heavyweight Title

      NEWARK, N.J. -- With one awkward lunge, Jon Jones' big toe about popped off his left foot.

      Before he hobbled out of the octagon, Jones had one more spectacular title defense to finish, returning to the site of his championship win and staking his claim as perhaps the greatest UFC light heavyweight of all time.

      Jones bloodied an overmatched Chael Sonnen with a series of strikes to the face in the first round to win by TKO and defend his light heavyweight championship for the fifth straight time on Saturday night at UFC 159.

      Nicknamed "Bones," Jones proved he was a champion down to the bone ? the one that jabbed its way out of his toe with one misstep. Jones (18-1) suffered a compound fracture and needed a stool inside the cage to complete his post-fight interview.

      He needed no time finishing off the trash-talking Sonnen (28-13-1).

      After his third takedown of the round, Jones buried a knee to the body, then went to work on Sonnen's face. Sonnen covered up as the ref stopped the fight at 4:33 of the first.

      "I felt I came out here and was strong and courageous," Jones said.

      Jones said he was hurt late in the abbreviated round. Had the fight go on, Jones would have been unable to continue.

      "They would have stopped it. In a second," UFC president Dana White said.

      With the win, Jones matched UFC Hall of Famer Tito Ortiz's light heavyweight mark of five straight successful title defenses. After beating Shogun Rua to win the belt, Jones went on to defeat Rampage Jackson, Lyoto Machida, Rashad Evans and Vitor Belfort.

      There was no immediate word how long Jones would be out. But if he returns and wins again, Jones would stand alone in the record book.

      "It would be hard not to call him the greatest light heavyweight of all time," White said.

      Jones returned to the Prudential Center and the site of his championship win over Rua in March 2011. He strolled to the cage and took delight in the long walk toward his latest title defense.

      Sonnen stared at the giant video screen and beckoned for Jones to walk out. Sonnen stared down Jones for the entire walk to the cage and yelled out, "Come on, boy!" at the champ.

      Jones dragged out his intro and hugged his mom before he stepped inside the octagon. He performed a cartwheel on the mat as the crowd booed the extracurricular theatrics.

      "Last time I was here, I had all these goals and aspirations to become a champion," Jones said. "Now, I'm here in the same building as one of the best champions."

      Jones, a former college wrestler and the brother of two NFL players, made quick work of Sonnen with uppercuts and elbows.

      "I've had a lot of fights and a lot of them haven't gone my way," Sonnen said. "But I've only been beat up twice and that was number two."

      Jones rested in the cage with the belt around his waist as doctors wrapped his toe. He gingerly walked out with no assistance and his left big toe bandaged up. Backstage, the entire left foot was in a bulky wrap. White said Jones would need a hospital visit.

      "I was supposed to go to Jamaica after this," Jones said. "Now, I don't think it's going to happen."

      The UFC hoped to pull off this bout in September as the main event at UFC 151.

      Jones, though, refused to fight Sonnen on eight days' notice after contender Dan Henderson was forced to withdraw because of injury. Jones didn't want to risk his title against a last-minute replacement in Sonnen, so he balked at the fight.

      White was forced to cancel a pay-per-view show for the first time in his tenure. Jones survived a near submission and would defeat Vitor Belfort at UFC 152 in late September.

      With New York one of the few states that has yet to legalize MMA, the UFC has often turned to New Jersey to stage its biggest cards on the east coast. White said he was no longer making New York a top priority.

      "If New York never happens, it won't hurt UFC one bit," White said. "But imagine what it can do for New York."

      Pat Healy opened the pay-per-view card with a third-round submission win over New Jersey native Jim Miller. Bruce Buffer was booed after he misspoke and named Miller the winner. In other PPV bouts, Phil Davis won a unanimous decision over Vinicius Magalhaes; Roy "Big Country" Nelson used a big overhand right to stop Cheick Kongo in the first round; and Michael Bisping bloodied Alan Belcher with a nasty cut near the right eye and won via TKO.

      WASHINGTON (Reuters) - As he nears the end of a dozen years as director of the FBI, Robert Mueller finds himself defending the agency over its handling of two high-profile cases. It is a familiar spot for the low-key ex-Marine.

      At the request of President Barack Obama, Mueller stayed on for two years beyond the job's 10-year term to help stabilize law enforcement's fight against domestic and international threats to U.S. security. Recent events - the bombing at the Boston Marathon and ricin-laced letters sent to Obama and a U.S. senator - have left Mueller dealing with suggestions that agency missteps may have added to the damage.

      Mueller, 68, who is scheduled to leave office in early September, has endured many congressional attacks against his agency's performance. While he is not universally praised on Capitol Hill, he has won enough bipartisan support to be considered a success.

      Tellingly, it was a target of the 2001 anthrax letters - Democratic Senator Patrick Leahy of Vermont - who told Mueller at a 2008 hearing that he seriously doubted the findings of the FBI's long and complicated anthrax investigation. But three years later, Leahy as Senate Judiciary Committee chairman helped Mueller win a two-year extension of his term.

      The FBI chief gets far milder treatment than some other prominent members of the 0bama administration, such as U.N. Ambassador Susan Rice. She came under heavy fire from Republicans for remarks she made after the September 11, 2012, attack on the U.S. Mission in Benghazi in which four Americans were killed, including Ambassador Chris Stevens.

      In Washington, where making enemies is easy, Mueller wins high scores from members of Congress for his competence, even as he guided a vast expansion of FBI powers since the hijacked plane attacks of September 11, 2001.

      "I believe he is well liked, even though I find fault with a lot of his policies, or how he does things," Senator Charles Grassley, the top Republican on the Judiciary Committee, said in an interview. "I think he's well intentioned ... it's kind of difficult for me to criticize him even when there is a screw-up," Grassley added.

      This month, the FBI has faced fresh assaults over its failure to spot the potential danger from Tamerlan Tsarnaev, a suspect in the April 15 Boston Marathon bombings, after Russia asked the bureau to investigate him two years ago. Tamerlan Tsarnaev died in a police shootout and his brother, Dzhokhar Tsarnaev, has been charged in the bombings that killed three people and injured more than 200.

      Two senior Republican lawmakers complained Tamerlan Tsarnaev was yet another in a series of cases in which a person investigated by the agency had later taken part in attacks.

      Soon after the Boston bombings, the FBI accused an Elvis impersonator of sending letters containing ricin to Obama and other officials, only to quickly drop the charges for a lack of evidence.

      Mueller and his leadership team have briefed members of Congress about the cases, but further inquiries are likely.

      "I think he is ready to go home. He has had 12 years," said Dutch Ruppersberger, the top Democrat on the House of Representatives Intelligence Committee. He praised Mueller, who was first nominated to the job by a Republican president, George W. Bush.

      "He has had some major issues to confront, including 9/11, then Russian and China threats, cyber threats," he said.

      Some lawmakers say that despite the Boston blasts, the FBI thwarted other plots in recent years, including one to bomb New York's subway system. They also note that there was an arrest within days of the Boston bombing.

      "I thought they (the FBI) did fabulous in getting to the bottom of the Boston bombing, but as great as that was, it was embarrassing to bring in a guy who had nothing to do with the ricin mailings," said Representative Louie Gohmert, a Texas Republican who serves on the Judiciary Committee, which has oversight of the FBI.

      Mueller's office did not comment, although Mueller has praised the work of the FBI and other law enforcement agencies for the arrest of the Boston bombing suspect.

      LOW PROFILE?

      Some think Mueller's secret to success has been keeping a low profile in a town where many people are constantly angling to get attention. Mueller, while doing a lot of closed-door briefings for leaders, does not talk much to the media.

      "I think he has been successful because he hasn't been a press hog," Grassley said.

      Mueller, a former Justice Department official, was nominated for the top FBI job in 2001 and took office days before the September 11 attacks on New York and Washington.

      When Obama asked Mueller to stay on, some Senate Republicans initially balked. One, Senator Rand Paul of Kentucky, came around after Mueller met with him to discuss the bureau's handling of a Kentucky case.

      Mueller fielded heavy criticism from his earliest days in office.

      After the 9/11 attacks, politicians from both parties questioned how the FBI had missed several warning signs of the hijackings, such as a memo from a Phoenix agent about Middle Eastern men taking flight lessons.

      The anthrax case led to criticism because the bureau focused for so long on the wrong man, a mistake that ultimately cost the government millions of dollars in settling a lawsuit.

      The FBI finally concluded that Army scientist Bruce Ivans was responsible for the anthrax attacks, but he killed himself before charges were brought.

      In 2008, Leahy, then the Democratic chairman of the Judiciary Committee, told Mueller he did not believe the FBI finding that Ivans was solely responsible. Leahy said he thought others had to be involved.

      Mueller reorganized the FBI to expand its analytical capability and improve its intelligence collection. He also beefed up its bioterrorism capabilities.

      He has been praised for resisting some parts of the expansion of domestic surveillance under Bush.

      Grassley said Mueller had not always been as responsive as possible to the senator's letters or "as protective of whistleblowers as he should be."

      But he said there should not be another extension as director for Mueller, no matter how well liked he may be.

      The purpose of the law limiting the director's term "is to make sure we don't get into this J. Edgar Hoover syndrome, that one guy is so indispensable," Grassley said, referring to the former FBI director of almost four decades. "We don't want to get caught in that syndrome again."

      The research is part of a partnership between Iowa State and Penn State known as PROSPER, which stands for Promoting School-Community-University Partnerships to Enhance Resilience. PROSPER administers scientifically proven prevention programs in a community-based setting with the help of the Extension system in land grant universities.

      The results are based on follow-up surveys Spoth and his colleagues conducted with families and teens for six years after completing PROSPER. Researchers developed the prevention programs in the 1980s and 1990s to target specific age groups. Spoth said understanding when and why adolescents experiment with drugs is a key to PROSPER's success.

      "We think the programs work well because they reduce behaviors that place youth at higher risk for substance misuse and conduct problems," Spoth said. "We time the implementation of these interventions so they're developmentally appropriate. That's not too early, not too late; about the time when they're beginning to try out these new risky behaviors that ultimately can get them in trouble."

      PROSPER administers a combination of family-focused and school-based programs. The study involved 28 communities, evenly split between Iowa and Pennsylvania. The programs start with students in the sixth grade. The goal is to teach parents and children the skills they need to build better relationships and limit exposure to substance use.

      "One of the skills students are taught through the school-based program is assertiveness, so that they feel comfortable refusing to do something that might lead to them getting in trouble," Spoth said. "We try to help parents be more attuned to what their children are doing, who they're with, where they're going, effectively monitoring, supervising and communicating with their children."

      Parents say the program works

      Michelle Woodruff will admit that being a parent is hard work.

      "Absolutely, underline and capital letters -- it is hard," said Woodruff, a mother of four sons who range in age from 13-21 years old. But the lessons learned through the PROSPER program, she believes, made her and her husband better parents and also brought out the best in their children.

      "It was a lot of little things that made us re-evaluate how we parented," Woodruff said. "I think it makes children more responsible not only to themselves, but their parents and the community. They want to represent their families well, their schools well, their churches; I think it just makes them want to be a better person."

      Woodruff is now a member of the PROSPER team in Fort Dodge, where she encourages and supports other parents who participate in the program. Facilitators of the family-focused program use games and role-playing to help parents and children improve communication and set expectations for behavior. Woodruff would like to see more families take advantage of the opportunity.

      "Do it, not only for the one-on-one time with your child, but also to meet other like-minded parents," Woodruff said. "We're just trying to come together as a community to raise the best kids that we can possibly raise so that they're successful members of society as adults."

      Community benefits

      The ongoing community partnerships are evidence of the PROSPER program's sustainability, Spoth said. The results extend beyond a reduction in prescription drug or marijuana use. Researchers know that substance abuse often leads to other problem behaviors, so prevention can have a ripple effect and cut down on problems in school and violent behaviors in general. The benefits are measured in economic terms as well as the overall health and outlook of the community.

      "There are things that can only happen over time if you have sustained programming, because more and more parents are exposed to programs that help them address all of the challenges in parenting," Spoth said. "As a result, people feel like they're making connections, their community is a better place to live, and they are positive about the leadership in their community."
